NSW: civil libertarians slam proposed e mail laws

Civil libertarians say proposals put forward by the New South Wales Law Reform Council
to regulate e-mails are too harsh and intrusive.

The proposed laws would allow employers to read workers' e-mails if they either struck
an agreement with staff or provided 14 days' notice of the action.

But TERRY O'GORMAN from the Council of Civil Libertarians says the two requirement
are illusory and meaningless.

He says workers would feel pressured to agree to e-mail monitoring to avoid looking guilty.

He says an employer should only be able to monitor e-mails after he or she has made
out a case to the Industrial Relations Commission that the computer is being used for
suspected criminal conduct or significant commercial espionage.
